WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK
ASSUMPTION OF RISK
I understand that participation in soccer and SummerFest 3v3 involves inherent risks, including but not limited to falls, collisions, contact with other players or equipment, uneven playing surfaces, heat and weather conditions, sprains, fractures, concussions, serious injury, illness, and, in rare circumstances, death. I voluntarily authorize the participant to participate in SummerFest 3v3 and knowingly accept and assume the risks associated with participation. I certify that the participant is physically capable of participating and agree that the participant will follow tournament rules, referee instructions, and safety requirements.
RELEASE OF LIABILITY
To the fullest extent permitted by applicable law, I, on behalf of myself and, where applicable, as the parent or legal guardian of the minor participant, release and agree not to hold liable Unashamed Ballers, its directors, officers, employees, volunteers, coaches, referees, contractors, agents, representatives, sponsors, affiliated organizations, and the owners, operators, and governmental entities responsible for the tournament facilities (collectively, the “Released Parties”) from claims arising out of or relating to participation in SummerFest 3v3, including claims arising from the ordinary negligence of a Released Party, to the extent such claims may lawfully be released. This release does not apply to any claim or legal right that cannot lawfully be waived.
MEDICAL AUTHORIZATION
In the event of injury, illness, or medical emergency, I authorize tournament personnel to contact emergency medical services and obtain or facilitate reasonable emergency medical care for the participant when necessary. I understand that Unashamed Ballers does not provide medical insurance for participants and that I am responsible for medical expenses incurred on behalf of the participant, subject to applicable insurance coverage or other legal responsibility. I understand that a participant displaying signs of concussion or other potentially serious injury may be removed from play and may be required to obtain appropriate medical clearance before returning.
TOURNAMENT CONDUCT
I agree that the participant and accompanying family members and spectators will comply with the SummerFest 3v3 Official Tournament Rules and standards of sportsmanship. Fighting, threats, abusive or discriminatory language, harassment of referees or tournament personnel, dangerous behavior, or other serious misconduct may result in removal, suspension, forfeiture, or tournament disqualification.
PHOTO, VIDEO & MEDIA RELEASE
I grant Unashamed Ballers and its authorized representatives permission to photograph, film, and record the participant during SummerFest 3v3 and related tournament activities. I authorize Unashamed Ballers to use the participant's image, likeness, voice, photographs, and video recordings for tournament coverage, social media, websites, promotional materials, advertising, event recaps, and other communications promoting Unashamed Ballers, its programs, events, and mission, without additional approval or compensation. I understand that content published online or through social media may be publicly accessible and may be shared by third parties beyond the control of Unashamed Ballers.
PARENT/GUARDIAN AUTHORIZATION
If the participant is under 18, I certify that I am the participant's parent or legal guardian and have authority to execute this agreement and authorize the participant's participation. This agreement is governed by the laws of the Commonwealth of Virginia. If any provision is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
